In line with Law 2121/93 and its founding Law 1013/71, HMGS possesses “Copyright, related
rights and cultural affairs” and Ownership and property rights of its geographic material.
HMGS concedes license of the above materiel for commercial purposes, only after the
signing of a related contract with the interested parties. The contractual amount is
determined on the basis of the length of the area, the amount of the information drawn and
the number of copies.
Article 13 of the Legislative Decree 1013/1971 (Government Gazette 201 A’), is replaced by
the provisions of Article 11 of the Law 3257/2004 (Government Gazette143/A/29.7.2004)
on “Arrangements of issues related to Armed Forces personnel and other provisions” as
follows:
- According to the above Law as “geographic (geo) material” is defined any geodetic,
astronomical, geophysical, geomagnetic, aerial-photographic, topographic,
cartographical, hydrographical, aeronautical, satellite and any other materiel or
element in analog or digital form, that is produced and can be used for the production
of maps and ground diagrams as well as naval and aeronautical maps in analog or
digital form.
- The geo- materiel that is produced by the Hellenic Military Geographical Service is
under exclusive copyright of the Hellenic Armed Forces and their disposal to third
parties is subject to copyright provisions.
- The production and editing of national maps (in analog or digital form) of any range,
by the State, public entities, private law natural and legal persons, through the use of
HMGS geo-material is allowed only following approval of the Hellenic Army General
Staff. For such use, intellectual property rights are due by the private law natural and
legal persons.
- Whoever is granted permission to produce/edit maps is obliged to comply with the
Hellenic Army instructions related to the disclosure or not of the confidential nature of
the maps, their content and composition in general. This permission is noted and
stamped upon the copies of the maps.
- The private law natural and legal persons are allowed to perform aerial photography
air flights by their own means for geo-material production purposes, only following
HNDGS approval and obligatory participation of an HMGS control officer on board and
to the follow on related data processing. Issues related to the control of the above
works and the compensation payments that are due by the interested parties are
settled by the Joint Ministerial Order of the Ministers of National Defence, Finance,
Transport and Communications.
- State, public entities, private law natural and legal persons are allowed to produce,
dispose and handle geo-materiel through the use of less than one meter high
resolution cartography derivatives, satellite images or other materiel produced from
whatever source, only following HMGS control of the confidential nature or not of the
subject materiel.
